'I deal with people like you all the time': Pompous landlord claims tenant only deserves 1/3 of security deposit, tenant sues and wins

    Landlord says "I deal with people like YOU all the time!", big mistake. My wife and I had a cool apartment in our downtown area that we really liked... but our landlord s and the parking situation was awful. After months of him neglecting to fix anything, we realized that a mortgage would be cheaper and I could have a garage.

    We didn't want to wait so we would need his blessing to break the lease. I told him that I would like to move out in 30 days, and he said that if he was allowed to show the apartment for those 30 days (easily) then I would have his blessing and he'd return my deposit.

    <fast forward 30 days, he showed the apartment to a bunch of people, we always had it clean and ready so that it would rent easily, and he had someone scheduled to move in within days of us moving out>

    After a few days I went to his office to pick up my deposit, he looked shocked and told me he'd left it with the front desk in the lobby... which seemed weird. So I go grab the envelope and head out to my car... only to realize that the check is for 1/3 the deposit.

    So I head back up to his office and inquire about the "mistake". He became extremely hostile towards me, telling me how "in X number of years renting apartments, I've never seen one in such deplorable condition, you're lucky I gave you ANYTHING back"... ooookay... what?

    The place was in substantially better condition when we moved out than when we moved in (other than the leaky roof and broken window pulleys that we had requested he fix for months).

    I had fixed/replaced lots of little things that were in my skillset (missing outlet covers, broken closet/bathroom doorknobs, etc). I was trying to be reasonable with him but he wasn't having it, I honestly felt like he was trying to goad me into h him so that he could call the p Eventually, I told him that I didn't want to take him to court over it, but I would if I had to. His response? "Fine, I deal with people like you all the time".

    Big mistake pal. So I sued him in Magistrate Court (small claims) for treble-damages (withheld deposit x3) and our court date was scheduled. I had photos, a copy of our lease, copies of all the letters I had submitted asking for repairs to be done, a copy of our state tenant law, etc. He brought a copy of the lease with him, that was his only "evidence".

    Quick backstory, when signing the lease it said there was a $100 non-refundable pet deposit PER pet, but the lady that worked for him and had us sign the paperwork said that the policy had changed so that it was now $300 per pet, but $200 was refundable. I was naive and signed the paperwork even though it didn't reflect that I was paying the extra $200, I did write it in the memo of the check that $ deposit and $300 was pet deposit. was the

    explain to the judge that not only was the apartment NOT damaged, but our landlord hadn't even done a preliminary walk-through with us to assess the condition when we moved in, so (by law) he had already lost the ability to retain any part of the deposit. That was basically my entire case.

    My landlord got his turn, and man did he look smug. Landlord: "LS-CRX, how many pets did you have when you moved into the apartment?" Me: "One" Landlord: "And how many did you have when you moved out?" smirks at the judge

    Me: "Two" Landlord: "And what does it say on your lease about pet deposits?" Me: "That you have to pay $100 per pet, non- refundable" I see where this is going Landlord: "And how much did you pay?" Me: "$300" Landlord: face drops

    The judge ended up awarding me double- damages plus court costs. Ironically I had called my landlord up a few days before our court date to see if he wanted to just pay me what he owed... but he doubled-down on being an He waited until the absolute last day possible to send me a check for the amount awarded, what a nice housewarming present for our first home!

    latinashrty This is what I would like to call karma!! He thought he had a one up on you. You are truly a great human being for even offering the amount owed to be paid after the ruling in your favor. He had too much pride to admit he was in the wrong and it cost him.     LS-CRX OP. Maybe I worded it badly, I called him before going to court and said he could just pay what he owed and I would withdraw my case against him. He doubled-down on being a O probably figuring that the court would side with him and he wouldn't have to pay me anything. He was incorrect. 104 Reply Share

    LS-CRX OP. Sadly the CRX has been out of my life for many years... but I still hold a place in my heart for it.
